Annex No. 3 to the Public Contract (Offer) for Equipment Placement (Colocation) Services
EQUIPMENT HANDOVER AND ACCESS POLICY
McLaut Colocation
CherkasyVersion effective 01 November 2026
Translation from Ukrainian. The Ukrainian version prevails.
This Policy is Annex No. 3 to the Public Contract (Offer) for Equipment Placement (Colocation) Services of LLC "McLaut-Service" and of TOV "MEDHOSTER.COM" published at https://mclaut.cloud. It governs how Equipment is handed over, installed, changed and returned. Terms defined in the Offer have the same meaning here.
1. Principle
1.1. The Technical Node is closed to customers. The server room is small, its location is confidential and the Contractor does not disclose it or admit Customers, their staff or their contractors.
1.2. All handovers take place at the Contractor's office at 18000, Cherkasy, vul. Baidy Vyshnevetskoho, 37, Monday to Friday, 09:00–18:00, by prior arrangement. A handover outside those hours may be arranged if staff are available and is charged at the urgent rate in the Price List.
1.3. All work on the Equipment inside the Technical Node — installation, removal, cabling, connection to power and any physical change — is carried out by the Contractor's staff.
2. Authorised Persons
2.1. The Customer names in a letter of authorisation the persons entitled to hand over and collect Equipment and to sign handover protocols ("Authorised Persons"). The letter is signed by the Customer's director, by the individual entrepreneur or by the natural person who is the Customer, and is sent to colocation@mclaut.com as a signed scan or with a qualified electronic signature. The form of the letter is at the end of this Policy.
2.2. For each Authorised Person the letter states: full name, type and number of the identity document, telephone number and e-mail address. The Customer may name up to 5 (five) Authorised Persons.
2.3. The Customer updates the letter without delay when an Authorised Person changes. A revocation takes effect when the Contractor receives it; until then the Contractor may rely on the last letter received.
2.4. At handover each Authorised Person presents an original identity document. The Contractor may refuse to release Equipment to a person who is not named in the letter or cannot prove their identity.
3. Handover of Equipment to the Contractor
3.1. The Customer books the handover at least 1 (one) working day in advance by e-mail to colocation@mclaut.com or by telephone (0472) 520-520 or 097 0 520 520, 093 0 520 520, 096 0 520 520, 050 0 520 520, 063 0 520 520, 073 0 520 520, 099 0 520 520, stating the Equipment and the persons who will bring it.
3.2. Inspection. In the presence of the Authorised Person the Contractor inspects the Equipment: appearance and visible damage, model and serial numbers, size in units, rails or mounting brackets, power supplies and cables, and, where the Parties agree to switch it on, that it starts up.
3.3. Sealing. After the inspection the Contractor seals the Equipment. The seal numbers are recorded in the handover protocol. The Customer may not break the seals; the Contractor breaks them only for work under Section 5 and reseals the Equipment afterwards.
3.4. Handover protocol. The Parties sign a protocol stating the date, the Equipment with serial numbers, the seal numbers, the technical condition, the accessories handed over and any remarks. The protocol is signed in two copies, one for each Party, or exchanged as signed scans by e-mail. The protocol is the record of what the Contractor received.
3.5. The Contractor may refuse to accept Equipment that does not meet Section 4, or that could endanger the Technical Node, other customers or the network.
3.6. After the protocol is signed, the Contractor's staff transport and install the Equipment at the Technical Node and connect it to power and the network. Installation is charged according to clause 3.2 of the Offer.
3.7. The first acceptance of Equipment under an Order — inspection, sealing and the handover protocol — is free of charge. A repeat acceptance of the same Equipment, for example after the Customer's own work under clause 5.1(b), is charged according to the Price List.
4. Requirements for Equipment
4.1. Equipment handed over must:
- fit a standard 19-inch rack and come with rails or mounting brackets;
- operate on 220–240 V AC and come with suitable power cables (see the connector types below);
- be labelled with the Customer's name and a contact telephone number;
- be in good working order and free of damage, dust and pests;
- be listed in the Order, including its size in units and its expected power consumption.
4.2. The Customer takes away all packaging after the handover.
5. Changes to installed Equipment
5.1. Physical changes to installed Equipment — replacing disks, memory, cards or power supplies, adding or removing components — are made in one of two ways:
- (a) by the Contractor's staff at the Technical Node, on the Customer's written instruction sent by e-mail. The work is charged according to the Price List; the parts are supplied by the Customer and handed over at the office under Section 3. The Contractor breaks and renews the seals and records this in a protocol;
- (b) by the Customer at the office. At the Customer's request the Contractor removes the Equipment from the Technical Node and returns it at the office under Section 6. The Customer performs the work there, and the Equipment is handed over again under Section 3, inspected and sealed anew. Removal and reinstallation are charged according to the Price List.
5.2. Work that does not require physical access — operating system, software, configuration, restart — is done by the Customer remotely over the network at any time. Simple physical actions (power cycling, a visual check of indicators, reseating a cable) are covered by the remote hands service under clause 5.3 of the SLA.
5.3. In the event of a complete server replacement, clause 3.6 of the Offer applies: the previous server is removed within 7 (seven) calendar days.
6. Return of Equipment
6.1. The Contractor removes the Equipment from the Technical Node and returns it to an Authorised Person at the office, by prior arrangement, within the period agreed with the Customer and in any case within the periods set in the Offer.
6.2. The return is documented by a protocol stating the Equipment, serial numbers, seal numbers and condition. The Customer checks the Equipment at handover; remarks are entered in the protocol.
6.3. The Contractor may refuse to release Equipment while the Customer has overdue payments, notifying the Customer of the retention (clause 4.14 of the Offer and Art. 594 of the Civil Code of Ukraine).
7. Security of the Technical Node
7.1. The Technical Node is under video surveillance, guarded around the clock and connected to a central fire alarm.
7.2. Only the Contractor's authorised staff enter the Technical Node. Its address is confidential; the Contractor does not publish it and discloses it only where the law requires.
7.3. The Contractor may restrict its own work at the Technical Node during an air-raid alert, a curfew or on the instruction of state authorities; such restrictions are not a breach of the Contract.
8. Personal Data
8.1. The Contractor processes the personal data of Authorised Persons (name, identity document details, telephone number, handover dates) in order to identify them at handovers, on the basis of points 3 and 6 of part one of Article 11 of the Law of Ukraine "On Personal Data Protection". Handover records are kept for 3 (three) years.
8.2. The Contractor's office is under video surveillance. Recordings are used only for security purposes.
9. Breaches and Changes
9.1. If the seals are broken by the Customer, or Equipment is changed other than under Section 5, the Contractor may refuse further service of that Equipment until the matter is clarified, and is not liable for faults arising from such changes.
9.2. The Customer is liable for damage caused by its Authorised Persons at the Contractor's office (clause 6.5 of the Offer).
9.3. The Contractor may amend this Policy in accordance with clause 9.2 of the Offer.
